These are the General Terms of Contracting applicable to entities, professionals or private users who use Motoraldia services through www.motoraldia.net, its applications and its blog.
1.1 These Terms apply to the use of the services by "Users" — professionals or private — together with the conditions of the contracted service package.
Services are provided by Nomes3 Digital, c/ Manuel Cerqueda i Escaler 4-6, Centre de Negoci Building, Floor 0 office 6, represented by its managing director, specifically for the Motoraldia online platform.
1.2 Motoraldia may modify these terms if the changes are reasonable and do not entail economic disadvantages for the User. Changes will be notified by email and considered accepted unless the User objects within the following 10 business days.
2.1 Motoraldia maintains an Internet platform where motor-vehicle ads can be created and managed by the User against the price set in the contract. The object is to make the information accessible to third parties through different platforms.
2.2-2.3 Any allowed use is governed by these Terms. Motoraldia may modify, suspend or replace paid services at any time.
3.1 By submitting ad data, the User grants Motoraldia transferable, non-exclusive, unlimited rights to reproduce, distribute, archive and edit the content.
3.2-3.4 All content and distinctive signs are protected by intellectual property laws. Any software supplied by Motoraldia is licensed non-exclusively and non-transferably. Breach entails contractual compensation determined in court.
4.1-4.5 The User must register with truthful data. Motoraldia may request additional documents. Once data is sent it counts as a contract proposal; if Motoraldia does not confirm within 48 hours (by email or by publishing the ad), the User is not bound. Each User registers only once; branches register independently.
4.6-4.16 The User must immediately report any data change, never disclose their password, and is liable for its misuse. In accordance with Andorran Law 29/2021 on personal data protection, the data becomes part of the Motoraldia Users file managed by Nomes3 Digital. The User may exercise their rights of access, rectification, opposition and cancellation by emailing info@motoraldia.net.
5.1-5.6 Motoraldia bills according to the modality set in each contract (monthly, quarterly, half-yearly or yearly). Payment is by direct debit (professionals) or SMS / credit card (private users). Default entitles Motoraldia to charge legal interest.
5.7-5.9 Any delay in publication after payment is not Nomes3 Digital's responsibility. Publication deadline: 24 hours from the verified payment.
6.1 The contract may be indefinite (terminable with 4 weeks' notice by certified letter) or fixed-term (3 weeks' notice; otherwise tacitly renewed for the same period).
7.1 Motoraldia may extraordinarily terminate if the User breaches the Terms, fails to meet main obligations (7 days to cure), does not pay or becomes insolvent.
8.1-8.7 Acceptance of content is discretionary. Upon third-party complaints or repeated breaches, Motoraldia may remove content and block access. Contractual penalty of €120 per vehicle if a trader poses as a private user.
9.1-9.2 The User is the sole responsible for content and its accuracy. Motoraldia is not required to monitor information nor to look for signs of illegal activity. The User holds Motoraldia harmless from any third-party claim arising from their ads.
10.1-10.3 Motoraldia will keep the database available, excluding maintenance, offline backups and force majeure. Motoraldia is not responsible for the visual quality of the images uploaded by Users.
11.1-11.7 Motoraldia is liable mainly for breach of essential contractual obligations, defective products or accepted warranties. Total liability is capped at €300. No liability for indirect damages, defects or loss of profit. This exclusion extends to employees, collaborators, representatives and agents.
12.1-12.4 The User must comply with applicable law and refrain from posting racist, pornographic, defamatory or offensive content. They will hold Motoraldia harmless from any third-party liability arising from their breaches.
13.1-13.6 The base price depends on the contracted package. Price adjustments will be notified 15 business days in advance. The User may keep their tariff during the contract; continued use after a change counts as tacit acceptance.
The Principality of Andorra shall be the competent jurisdiction. This contract is governed and construed by the laws of the Principality of Andorra.
